§ 1 Who enters into a contract with whom
The provider is Tobias Westrich, 66287 Quierschied (sole proprietor, see the legal notice). These terms apply to all contracts for the use of Cueshot Pro and Pro+. Use of the free version needs no contract with us. The paid plans are offered to people aged 18 or over; the contract language is English.
§ 2 What Cueshot is
Cueshot is a macOS application that creates screenshots, screen recordings and dictations and prepares them so that an AI program can read them. In the free version this happens on the user's own Mac. The paid plans add functions that need our server: cloud dictation, AI clean-up of dictation, the premium voice and sharing bundles and messages. For these, the content you send is processed on our server and by the model providers named in the privacy policy. These functions need an internet connection. Requirements: a Mac with Apple silicon and macOS 26 or later. The free version's speech recognition needs a one-time download of the model (about 460 MB) that you start yourself.
Cleaned-up dictation and the premium voice (synthetic speech) are produced by AI models. They are meant to be checked by you before you use them.
§ 3 Free version and paid plans
Cueshot can be used free of charge and without an account: dictation, screenshots, recordings and the connection to your agent run on your Mac without a time limit. To try the cloud functions you get 3 trial uses per calendar month.

No VAT is charged because the provider is a small business under § 19 UStG. Payment is by card, including Apple Pay and Google Pay where your device offers them, through the payment provider Stripe. When a quota is used up, Cueshot switches to the local model for the rest of the month; nothing is charged in addition. The limit on AI clean-up (30,000 requests per calendar month; each request to the clean-up function counts once) is a protection against misuse, not a limit anyone who dictates will reach.
§ 4 Free trial
The first paid plan of an account starts with a 7-day free trial. A payment method is required to start it. Unless you cancel before the trial ends, the subscription continues and your payment method is charged the price of the plan you chose, on the day the trial ends and then every month or year. The end of the trial and the first payment date are shown in the checkout and in the confirmation email; we also send a reminder two days before the trial ends, but the reminder is a courtesy. The trial is available once per account. If you cancel during the trial, nothing is charged.
§ 5 How the contract is formed
The checkout page shows the plan, the price, the trial and the renewal before you order. By clicking the order button, which is labelled to show that it creates an obligation to pay, you make a binding offer. We accept it by activating your plan and confirming it by email; the email also contains these terms' key points and the notice on the right of withdrawal. We do not store the contract text separately for you; these terms stay available at this address, and the confirmation email is your record. Before you click the order button you can check your choice on the checkout page and correct it — go back, change the plan or the billing period, or close the page without ordering.
§ 6 Term, renewal and cancellation
The contract runs for an indefinite period and renews automatically for the billing period you chose — one month or one year — until you cancel. It can be canceled at any time, effective at the end of the current billing period; there is no notice period. You keep the plan until that day, you are not charged again, and the days you have already paid for are not refunded in part. During the trial, cancellation means nothing is ever charged.
Cancel in Cueshot under Settings → Account → Manage subscription, or with the cancellation function on this website — no account needed, two clicks, confirmation by email — or informally by email to info@westrich-webdesign.de. Until the end of the period you can take the cancellation back under Manage subscription. After the contract ends, Cueshot keeps running on the free version, and everything you recorded stays on your Mac.
The right to terminate for good cause remains unaffected. Changing between Pro and Pro+ is possible under Manage subscription; the price difference for the rest of the period is calculated and charged or credited at once.
§ 7 Right of withdrawal
Consumers have a 14-day right of withdrawal, counted from the conclusion of the contract — the trial days are part of it. The full notice with the model form is on the right of withdrawal page; you can withdraw there without an account at the withdrawal function. On withdrawal, we refund every payment you made for the contract in full, even if you used Cueshot Pro in the meantime.
We do not ask you to give up the right of withdrawal for using Pro right away (§ 356 BGB). It therefore stays in full for all 14 days.
§ 8 Payment, failed payments, invoices
The price is due at the start of every billing period. If a payment fails, Stripe tries the payment method again over the following days and we email you; Pro keeps working in the meantime. If the payment cannot be collected in the end, the subscription ends and the account returns to the free version. Invoices are issued by Stripe on our behalf and are available from the email receipt and under Manage subscription; they carry the note that no VAT is charged under § 19 UStG.
§ 9 Inviting friends: the credit and the rules
The credit. Every account has a personal invite link and code. If a person who is new to Cueshot Pro signs up through your link or code and makes their first payment for Pro — that is, once their free trial has ended and money has actually been taken — you get one month of Pro (the value of one month of the Pro plan, €4.99) as a credit on your Stripe customer account, up to 12 months in total. The credit is used automatically against your next invoices; it is never paid out in cash and cannot be transferred. The person you invited receives nothing extra: everyone gets the same 7-day trial.
When it does not count. Not for your own address, for the same Mac or the same payment card as yours, for a person who has already tried or paid for Pro, or for someone who was invited by another person first. If the invited person's first payment is refunded (for example after a withdrawal) or disputed, the credit is taken back as far as you have not used it. We may refuse or reverse credits obtained by misuse, for example with accounts made up for the purpose.
Sending invitations. You send your link yourself: copy it, share it from the macOS share menu, or open a ready message in your own mail app and send it from your own address to people you know. Cueshot does not send invitation emails for you. Do not use the link for mass mailing or to approach people who would not welcome it. We may switch off the link of an account that is used against these rules. If you are a business, the credit may be taxable income for you; ask your tax advisor.
We may change or end the invitation program for the future; credits you have already earned stay.
§ 10 Sharing with friends: rules and how we deal with reports
With a paid plan you can send files, recordings, bundles and messages to people who have also added you as a contact, or give someone a link. The content is encrypted on your Mac before it is uploaded; we store the encrypted file for at most 30 days and cannot read it (details in the privacy policy).
Rules. Send only what you are allowed to send. It is forbidden to use the function for content that is unlawful in Germany or the EU — for example depictions of the abuse of children, incitement to violence or hatred, content that infringes copyright or other rights of third parties, or malware — and to harass others, to send unwanted content in bulk, or to hand content to the public at large through links. Someone who does not want to receive from you can ask us to remove their address from your contacts; sending only works between contacts who added each other.
What we check, and what we do. Because the content is end-to-end encrypted we do not look into it, and we use no automated tools and make no automated decisions about content. We act on a report (see the legal notice for how to report), on an order of an authority, and on what we can see without opening the content (sender, recipient, size, time). Where a file or link is unlawful or breaks these rules, we can remove the file, switch the link off, limit the sharing function of an account, or — for serious or repeated violations — end the account. If we suspect a criminal offence that threatens a person's life or safety, we inform the authorities.
Reasons and objection. If we remove content or restrict an account, we tell the person concerned by email, with the facts and reasons, whether we acted on a legal ground or on these rules, and how to object. Whoever sent a report is told how we decided. You can object to a decision at any time by replying to that email or writing to info@westrich-webdesign.de; a person reads it, decides again and tells you the result. Going to a court remains open to you.
§ 11 What the license permits
You receive a simple, non-transferable right to use Cueshot on your own Macs, for professional or private use. For a paid plan it lasts for the duration of the contract. Your account is personal and not meant to be used by others. Third-party components in Cueshot are under their own licenses, listed on the licenses page.
You are responsible for the content you record and send and share. Record other people only where the law and they allow it. Do not use Cueshot to share unlawful content or to harm others. We can remove a shared file or end an account that is used this way; you can report unlawful content at the address in the legal notice.
§ 12 Updates and changes
All updates are included for the duration of the contract. Individual features may change or be discontinued as long as the essential benefit — capturing, dictating and preparing content for AI programs — is preserved. If that essential benefit is materially reduced, you may cancel for good cause and receive a pro-rated refund of the current period. If a change affects your use more than slightly, we tell you about it in good time by email and you may end the contract free of charge within 30 days of receiving our notice (§ 327r BGB). System requirements: macOS 26 or later; if they rise during your term such that your Mac no longer meets them, the same right applies.
§ 13 Liability
We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For ordinary negligence, we are liable only for breach of material contractual obligations (cardinal obligations), and limited in amount to the damage typical and foreseeable for this kind of contract. Liability under the Product Liability Act remains unaffected.
Cueshot produces recordings, transcripts and AI-generated text by technical means. Speech recognition can mishear, compression can drop a detail and AI-generated text can be wrong. That is a property of the technology, not a defect, as long as the function works as described; we do not promise that the content produced is accurate, so check it and check what an agent is about to do on your behalf. Your statutory rights for defects of digital products (§§ 327 ff. BGB) are not affected by this.
§ 14 Price changes
The price you ordered stays the same for the billing period you paid for. If we want to charge more for an existing subscription, we tell you by email at least six weeks before the next billing period and ask for your consent. The new price applies only if you agree; your silence is not consent. If you do not agree, the subscription continues at the old price until the end of the period in which we end it — we may end it with effect from the end of a billing period by giving you at least six weeks' notice.
§ 15 Final provisions
German law applies. For consumers, this applies only to the extent that it does not deprive them of protections that are mandatory under the law of the country where the consumer has their habitual residence. Should any provision be invalid, the remainder of the contract stays in effect. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
